Thank you for shopping at Nighthawk Store.
If, for any reason, You are not completely satisfied with a purchase We invite You to review our policy on refunds and returns.
The following terms are applicable for any products that You purchased with Us.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Return and Refund Policy:
Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Nighthawk Manufacturing Inc., 3204-121 Ave NE.
Goods refer to the items offered for sale on the Service.
Orders mean a request by You to purchase Goods from Us.
Service refers to the Website.
Website refers to Nighthawk Store, accessible from store.nthawk.com
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
PRICING:
NIGHTHAWK MANUFACTURING INC. provides price lists to all recognized Nighthawk dealers.
Pricing & terms are subject to change without notice. Prices quoted are net F.O.B Edmonton, Alberta.
SHIPPING:
F.O.B Edmonton, Alberta or Holland Landing, Ontario.
All Shipments are sent UPS ground to most standard locations unless otherwise specified by Nighthawk or the customer. Shipping charges are added to invoices later on.
FREIGHT:
• Our Minimum Order requirement is $60.00.
• Orders of $60.00 - $999.99 will be charged the Full Freight amount.
• Orders over $1000.00 will receive Free Freight.
• All Back Orders will be charged a $10.00 Flat Rate.
Freight Rates do not include Tax and do not count toward the order total for free freight.
• Artisan of Canada products are not part of this freight policy
PAYMENTS
We do not accept credit cards on the Website any purchases are done with the account credit terms. All payments to invoices are done on a separate payment service in-house. The balance of any invoices can be checked on the Website but can not be paid.

CREDIT TERMS:
All New Accounts are opened under Credit Card or EFT Terms Only.
BACKORDERS:
All backorders will remain open for 12 months unless you notify us to close the PO short. Any backorders shipped out that are no longer required are subject to our return policy (See Return Policy below). After 12 months all open back orders will be automatically closed short.
RETURN POLICY:
Merchandise may not be returned without prior authorization. All returns must be accompanied by a return authorization number which is issued by Nighthawk staff. Unless the fault for the return is that of Nighthawk, all returns will be transported at the claimants' expense. All returns not covered by warranty will be subject to a 25% restocking fee. Any returned product originally purchased by Credit Card will be refunded back to the same card. All other refunds will be in the form of a credit memo only. Nighthawk does not give cash/cheque refunds.

Conditions for Returns
In order for the Goods to be eligible for a return, please make sure that:
• The Goods were purchased in the last 30 days
• The Goods are in the original packaging
• The Goods are not damaged in any way
The following Goods cannot be returned:
• The supply of Goods made to Your specifications or clearly personalized.
• The supply of Goods which according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is over.
• The supply of Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
• The supply of Goods which are, after delivery, according to their nature, inseparably mixed with other items.
We reserve the right to refuse returns of any merchandise that does not meet the above return conditions at our sole discretion.
CUSTOM ORDERS, CUSHIONS & DROP SEATS: Returns will NOT be accepted. *Custom orders may require a deposit.*
Returning Goods
You are responsible for the cost and risk of returning the Goods to Us. You should send the Goods to the following address:

We cannot be held responsible for Goods damaged or lost in return shipment. Therefore, We recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.
Your Order Cancellation Rights
You are entitled to cancel Your Order without giving any reason for doing so.
The deadline for cancelling an Order is before your Order ships any Order that has been shipped can not be cancelled, but it can be returned once you have received the Goods. Once Goods are received the return of Goods will fall under the Return Policy. If Goods are lost or damaged in transit Nighthawk does not accept responsibility and Goods will not be eligible for return.
CLAIMS:
Damaged or Lost Goods
Nighthawk does not accept responsibility for the loss or damage of goods in transit. Any loss or damage must be reported to the courier responsible for shipment immediately. Claims for shortage of goods must be reported to Nighthawk within 72 hours of receiving goods. **No Exceptions**
